Mare sought help after shooting, records show
LAS CRUCES — A horse suffering from three gunshots to the head reportedly sought help by making knocking sounds on the door of a Radium Springs home, according to court records.
The man whom investigators say pulled the trigger, 36-year-old Brian Drake of the 7400 block of Doña Ana Road in Las Cruces, will face one count of extreme cruelty to animals, a fourth-degree felony punishable by up to 18 months in prison, according to documents filed Friday in Magistrate Court.
He has not been arrested, but investigators have been in contact with Drake's attorney, said Curtis Childress, supervisor of Doña Ana County's Animal Control Division.
On June 9, the horse, a mare that investigators named Miracle, apparently approached a home in the 1800 block of County Road D61. According to a woman who lives in the home, she heard knocking at her front door.
"The horse had been wandering around," said Childress. "We followed its trail probably for a couple of miles ... it just walked up right to this lady's door and — I don't know — it bumped against the door or the house or what happened. But it was enough that it made knocking sound that the lady thought she had a visitor."
The mare is receiving treatment for its wounds. A veterinary exam showed two of the bullets exited the horse's neck while a third remains lodged in its skull.
Court documents show that Drake was not the owner of the horse but had taken possession from the owner in order to find her a home.
Investigators were led to Drake because one investigator recognized an old injury the horse had on her knee. That led to the ownership history of the horse.
The previous owner told sheriff's officials that he had given the horse to Drake because he offered to help find it a new home and knew someone who would take it.
When questioned, Drake allegedly told investigators he gave the horse to a pair of men who intended to sell the horse at auction. He could not identify the men.
A search warrant served on Drake's home yielded boots that matched prints found at a spot off a dirt road where the horse was believed to be shot, according to court records. Also found were a blood-stained shirt and a 9 mm handgun.
"In point of fact, I am the very opposite of an anthropomorphiser. I don't hold animals superior or even equal to humans. The whole case for behaving decently to animals rests on the fact that we are the superior species. We are the species uniquely capable of imagination, rationality and moral choice - and that is precisely why we are under an obligation to recognise and respect the rights of animals."
